What is a prenuptial agreement?
A prenuptial agreement (also known as a pre-nup) is a formal, written agreement between two partners prior to their marriage.
It sets out ownership of all their belongings (including money, assets and property) and explains how it will be divided in the event of the breakdown of their marriage.
A prenuptial agreement provides a clear agreement that can lead to peace of mind for both parties.
Are prenuptial agreements legally binding?
Prenuptial agreements are not recognised in this country by statute. This has led many to question their value. However, there have been a number of important cases where the judges have been prepared to reflect the terms of prenuptial agreements when making their decisions about the division of assets on divorce.
Why get a pre-nup?
The most common reasons for having a prenuptial agreement are:
You want to protect inheritance or future inheritance, both money and assets.
There are assets and/or property that would be very hard to split 50/50.
Either party own a business which they’d like to retain control of.
Second marriages: when one or both parties want to preserve some element of their estate for their children from a previous relationship.
Private companies where there are shareholders agreements in place.
Where there may be a debate as to which country divorce proceedings will be heard.
