Postnuptial agreements
Justin Law are a regional, top-tier specialist firm of family law solicitors. Family law is all we do, so whatever your situation it will be familiar to us. Our divorce lawyers can handle a broad range of family law matters from uncontested divorce to complex asset division.
One of the unique expertise of our family law solicitors is their knowledge on postnupital agreements. Pre and postnuptial agreements are increasingly popular in this country as more and more couples are alarmed by the potential cost, both financial and emotional, of getting divorced.
We act for clients locally and in the surrounding areas of Slough, Maidenhead, Windsor and Beaconsfield, the Thames Valley and M4 corridor as well as further afield, both nationally and internationally.
What is a postnuptial agreement?
A postnuptial agreement is just like a prenuptial agreement. The only difference is that the latter takes place before a couple marries or enters a civil partnership and the former happens afterwards. A contract is drawn up which provides details on how the couple’s assets and property would be split should the couple divorce or legally separate. One of the key components of the contract is that the parties agree that they will ask the court to make a “consent order” which separates their financial resources (e.g. house, investments, pensions etc.) in accordance with the postnuptial agreement.
Are postnuptial agreements legally binding?
The court has an overriding discretion to make such financial awards as it considers to be fair in the circumstances of any particular case, by reference to a whole range of factors. For example: how long the marriage lasted, the ages of the parties through to the extent of the financial assets and the contributions both parties have made to the marriage.
What are the reasons for a postnuptial agreement?
Couples may wish to enter into a postnuptial agreement for a variety of reasons such as:
Receiving an inheritance during the marriage.
The birth of a child.
The start-up of a new company/business venture.
To simply record beneficial interests in the assets already owned.
